Note on data transfer to the USA and other third countries

Among other things, we use tools from companies based in the USA or other third countries that are not secure under data protection law. If these tools are active, your personal data may be transferred to these third countries and processed there. 8. Audio and videoconferences

We use online conferencing tools, among other things, to communicate with our customers. The tools we use individually are listed below. If you communicate with us via video or audio conference over the internet, we and the provider of the respective conferencing tool will collect and process your personal data.

The conference tools collect all the data that you provide/use to use the tools (email address and/or your telephone number). Furthermore, the conference tools process the duration of the conference, the start and end (time) of participation in the conference, the number of participants and other “context information” related to the communication process (metadata).

Furthermore, the tool provider processes all technical data required to handle the online communication. This includes, in particular, IP addresses, MAC addresses, device IDs, device type, operating system type and version, client version, camera type, microphone or loudspeaker, as well as the type of connection.

If content is exchanged, uploaded or otherwise made available within the tool, this is also stored on the servers of the tool providers. Such content includes, in particular, cloud recordings, chat/instant messages, voicemails, uploaded photos and videos, files, whiteboards and other information shared while using the service.

Please note that we do not have full influence on the data processing operations of the tools used. Our options are largely determined by the corporate policy of the respective provider. Purpose and legal basis

The conference tools are used to communicate with prospective or existing contractual partners or to offer certain services to our customers (Art. 6 para. 1 lit. b GDPR). Furthermore, the use of the tools serves to generally simplify and accelerate communication with us or our company (legitimate interest within the meaning of Art. 6 (1) (f) GDPR). If you send us an application, we process the associated personal data (e.g. contact and communication data, application documents, notes taken during job interviews, etc.) to the extent necessary to decide whether to establish an employment relationship. The legal basis for this is Section 26 of the German Federal Data Protection Act (BDSG) under German law (initiation of an employment relationship), Article 6 (1) (b) GDPR (general contract initiation) and – if you have given your consent – Article 6 (1) (a) GDPR. Consent can be withdrawn at any time. Your personal data will only be shared within our company with individuals involved in processing your application.

If your application is successful, the data you have submitted will be stored in our data processing systems on the basis of § 26 BDSG and Art. 6 (1) (b) GDPR for the purpose of implementing the employment relationship.

Storage period for data

If we are unable to make you a job offer, if you reject a job offer or withdraw your application, we reserve the right to store the data you have provided on the basis of our legitimate interests (Art. 6 para. 1 lit. f GDPR) for up to 6 months from the end of the application process (rejection or withdrawal of the application). After that, the data will be deleted and the physical application documents destroyed. The storage serves in particular as evidence in the event of a legal dispute. If it is evident that the data will be required after the six-month period has expired (e.g. due to an impending or pending legal dispute), the data will only be deleted when the purpose for further storage no longer applies.

Longer storage may also take place if you have given your consent (Art. 6 para. 1 lit. a GDPR) or if statutory retention requirements preclude deletion.

Inclusion in the pool of applicants

If we do not make you a job offer, there may be the possibility of including you in our pool of applicants. In the event of inclusion, all documents and information from the application will be transferred to the pool of applicants so that we can contact you in the event of suitable vacancies.

Inclusion in the pool of applicants is based exclusively on your express consent (Art. 6 para. 1 lit. a DSGVO). Giving consent is voluntary and has no bearing on the ongoing application process. The data subject can withdraw their consent at any time. In this case, the data will be irrevocably deleted from the applicant pool, provided there are no legal reasons for retention.

The data from the applicant pool will be irrevocably deleted no later than two years after consent has been granted.

10. Our social media sites

Data processing by social networks

We maintain publicly accessible profiles on social networks. The individual social networks we use can be found below.

Social networks such as Facebook, Twitter, etc. can generally analyze your user behavior comprehensively when you visit their website or a website with integrated social media content (e.g. like buttons or banner ads). When you visit our social media pages, numerous data protection-related processing operations are triggered. Specifically:

If you are logged into your social media account and visit our social media page, the operator of the social media portal can assign this visit to your user account. However, your personal data may also be collected if you are not logged in or do not have an account with the respective social media portal. In this case, this data collection is done, for example, by cookies that are stored on your device or by recording your IP address.

With the help of the data collected in this way, the operators of the social media portals can create user profiles in which your preferences and interests are stored. This way, interest-based advertising can be displayed to you both within and outside of the respective social media site. If you have an account with the respective social network, the interest-based advertising can be displayed on all devices on which you are or were logged in.

Please also note that we are not able to retrace all processing operations on the social media portals. Depending on the provider, further processing operations may therefore be carried out by the operators of the social media portals. Legal basis

Our social media appearances are intended to ensure the broadest possible presence on the Internet. This is a legitimate interest within the meaning of Art. 6 para. 1 lit. f DSGVO. The analysis processes initiated by the social networks may be based on divergent legal bases, which are to be indicated by the operators of the social networks (e.g. consent within the meaning of Art. 6 para. 1 lit. a DSGVO).

Responsible party and assertion of rights

When you visit one of our social media sites (e.g. Facebook), we are jointly responsible with the operator of the social media platform for the data processing operations triggered during this visit. You can, in principle, protect your rights (information, correction, deletion, restriction of processing, data portability and complaint) both to us and to the operator of the respective social media portal (e.g. to Facebook).

Please note that, despite our shared responsibility with the social media portal operators, we do not have full influence on the data processing operations of the social media portals. Our options are largely determined by the corporate policy of the respective provider.

Storage period

The data collected directly by us via the social media presence will be deleted from our systems as soon as you request us to delete it, revoke your consent to store it or the purpose for storing the data no longer applies. Stored cookies remain on your device until you delete them. Mandatory statutory provisions – in particular, retention periods – remain unaffected.

We have no influence over the duration of storage of your data by the social network operators for their own purposes. For details, please contact the social network operators directly (e.g. see their privacy policies below).

We have a Facebook profile. The provider of this service is Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (hereinafter: Meta). According to Meta, the collected data will also be transferred to the USA and other third-party countries.

We have executed a joint controllership agreement with Meta (Controller Addendum). This agreement determines which data processing operations we or Meta are responsible for when you visit our Facebook page.
